R.S. Restorations Service Agreement
When a project is agreed upon, this Service Agreement will be emailed to the vehicle owner to sign electronically before the project can begin.
Service Rate
The Business shall charge the Client a rate of $90 per hour for all services rendered. The rate
shall be billed in quarter-hour increments. Due to the nature of working on classic vehicles, the
Business cannot provide an estimate for the total hourly rate for the project.
Payment Terms
The Client shall be responsible for paying all parts and material costs related to the restoration
and/or customization of the vehicle. Upon inspection of the vehicle the Business shall provide
the Client with an estimated cost of parts and materials prior to commencing work. The Client
acknowledges that these costs may change as the project progresses. The Client shall make a
deposit of the estimated total cost of parts and materials before at the start of the project so the
Business can order as needed.
Invoicing
The Business shall invoice the Client for all hourly work performed every Tuesday. The invoice
shall reflect the hours worked the prior week. Payment for invoice will be due upon receipt and
will be past due after (7) days. If invoices are past due after (15) days, work on the project will
stop. If invoices are past due after (30) days a minimum of $20.00 per week will be begin as a
storage fee.
Progress Updates
The Business shall provide the Client with updates on all hourly work performed on a weekly
basis.
Third-Party Vendors
The Client understands that the Business can not be held personally responsible for timing and
delivery of parts and/or materials from third-party vendors. The Business will do everything
possible to make sure parts are ordered in a timely manner to be here when the parts are
needed to install, but cannot guarantee those timeframes.
Ownership of Parts and Materials
The Client acknowledges that all parts and materials supplied by the Business shall remain the
property of the Business until full payment has been received.
Duration of Work
The duration of work shall be determined by the scope of the restoration project and the
availability of parts and materials. The Business shall use its best efforts to complete the work in
a timely manner.
No refunds
The Client will be assumed to have accepted the project work unconditionally unless a claim that
the project work is defective is made within (7) business days from the date of delivery.
Warranty
The Business shall provide a six-month warranty on all services performed, excluding normal
wear and tear and any damage caused by the Client. Parts are excluded under this warranty and
would fall under the third-party manufactures warranty terms
Marketing
The Business shall have the full rights to take pictures and videos of the progress of the project
for marketing purposes. The Client consents to the use of their vehicle's image and any photos
or videos taken by the Business for marketing purposes.
Termination
Either party may terminate this agreement upon written notice to the other party. In the event of
termination, the Client shall be responsible for payment of all services rendered and all parts and
materials purchased up to the date of termination.
Governing Law
This agreement shall be governed by and construed in accordance with the laws of the state of
Tennessee in which the Business is located.
Entire Agreement
This agreement constitutes the entire agreement between the parties and supersedes all prior
agreements and understandings, whether written or oral, relating to the subject matter of this
agreement.
Amendment
This agreement may be amended only by written instrument signed by both parties.
